  1. General Notes
Was ist die Dienstleistung von Mehmet Ucar – Clever-Rec, welches nachfolgend auch als CLEVER REC | MEHMET UCAR bezeichnet wird?
CLEVER REC | MEHMET UCAR is a specialized career consultant. Colloquially, our services are also referred to as those of a staffing agency, recruiter, headhunter, or personnel consultant.
Our mission is to find suitable candidates for permanent positions—or open positions (also known as vacancies)—for companies (hereinafter also referred to as “clients”) that commission us to conduct a search.
Important: Our career counseling services are free of charge for candidates. If we are successful in filling a vacancy with a suitable candidate, the client pays a fee to CLEVER REC | MEHMET UCAR.
How does the hiring process work from the candidate’s perspective?
  2. CLEVER REC | MEHMET UCAR and the recruiting company (the candidate’s potential future employer) mutually agree, on a contractual basis, to treat as confidential all information that comes to their attention during the process or the course of their collaboration, and in particular to comply with the provisions of the General Data Protection Regulation (GDPR). Given that many of the candidates placed by CLEVER REC | MEHMET UCAR are currently in permanent employment, we explicitly advise the recruiting company that personal information must be made available only to a small group of decision-makers, and that these individuals must be made aware of the confidential nature of the documents.
We find or identify a potentially suitable candidate whom we do not yet know—for example, through our database, social media, or LinkedIn.
We make initial contact with the candidate. If both parties are interested and wish to continue the dialogue, the candidate will be sent—for example, via email—a link to a consent form in accordance with Article 7 of the EU GDPR (storage and processing of data). As part of this consent process, we once again expressly point out that the data will be used exclusively for career counseling purposes and will only be shared with third parties (recruiting companies) with the candidate’s renewed consent.
We will introduce you, as a candidate, to the company and the position to be filled, along with the relevant terms and conditions.
If you, as a candidate, would like to be presented to the company, you will receive another link to explicitly grant permission or consent for the confidential sharing of your information with the company for this specific job opening.
We will present you as suitable candidates to the company and the relevant decision-makers. Moving forward, we will be there to advise and support you as candidates throughout the entire application, interview, and transition process.
If the outcome is positive, you, as the candidate, will sign an employment contract with the company. The fee for our services will then be billed to the company.
Since, for us, career counseling is ideally a partnership with you, the candidate, on an equal footing—and one that remains meaningful throughout your professional life—we regularly renew our permission to continue retaining your data. We’ll support you as a candidate for as long as you wish.

If data processing is based on Article 6(1)(e) or (f) of the GDPR, you have the right at any time to object to the processing of your personal data on grounds relating to your particular situation; this also applies to profiling based on these provisions. Right to Data Portability:
You have the right to have data that we process automatically—based on your consent or in fulfillment of a contract—provided to you or to a third party in a commonly used, machine-readable format. If you request the direct transfer of the data to another data controller, this will only take place to the extent that it is technically reasonable or feasible.
    SSL- bzw. TLS-Encryption:

In accordance with applicable legal provisions, you have the right at any time to receive, free of charge, information about your stored personal data, its origin, and recipients, as well as the purpose of the data processing; and, where applicable, the right to have this data corrected, restricted, or deleted. • If you have filed an objection under Article 21(1) of the GDPR, a balancing of your interests against ours must be conducted. Until it is determined whose interests prevail, you have the right to request that the processing of your personal data be restricted.

You may revoke this consent at any time. To do so, simply send us an informal email. The lawfulness of the data processing operations carried out up until the time of revocation remains unaffected by the revocation.

Since we generally maintain regular communication with you as a candidate, we will periodically renew your consent to the storage and processing of your data in the course of these communications.
